These terms apply to your use of zemaskin.com and to any order you place with us. Please read them before ordering. By placing an order, you agree to them.

1. About us

Zema is a trading name of ZEMASKIN LTD, a company registered in England and Wales under company number 17391184, with its registered office at 34, Peel hill, FY4 5JP

You can contact us at support@zemaksin.com. We aim to reply within two working days.

Where these terms say "we", "us" or "our", they mean ZEMASKIN LTD.

2. These terms and your legal rights

Nothing in these terms reduces your legal rights as a consumer. If anything here conflicts with your statutory rights, your statutory rights apply.

You have important rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. These are summarised in our Refund and Returns Policy, which forms part of these terms.

3. Our products are cosmetics, not medicines

Our products are cosmetic products. They are intended to cleanse, condition and improve the appearance and comfort of your skin and scalp.

They are not medicines, and they are not intended to diagnose, treat, cure or prevent any disease or medical condition, including seborrheic dermatitis, psoriasis or eczema.

If you have a diagnosed skin or scalp condition, are using a prescribed treatment, are pregnant or breastfeeding, or are unsure whether a product is suitable for you, please speak to your GP, pharmacist or dermatologist before use. Nothing on our website is medical advice, and it should never be used as a substitute for it.

4. Using our products safely

Please read the full ingredient list on the product before use, and do not use a product if you know you are sensitive to any of its ingredients.

We recommend patch testing before first use: apply a small amount to a discreet area, leave for 24 hours, and stop use if any irritation develops.

Follow the directions on the packaging. Stop using the product and seek medical advice if you experience irritation or an unexpected reaction, and please also tell us at [SUPPORT EMAIL], as we are required to keep a record of reported reactions.

5. Placing an order

Our website invites you to place an order. It is not an offer.

When you place an order you will receive an automatic acknowledgement. This confirms we have received your order. It does not mean we have accepted it. A contract between us is formed only when we send you a dispatch confirmation email, or, for pre-orders, an order acceptance email.

We may decline an order. Reasons include the product being unavailable, an error in the price or description, or our being unable to authorise your payment. If we decline your order we will tell you and refund any payment in full.

6. Pre-orders

Where a product is offered as a pre-order, the following applies in addition to everything else in these terms.

a. The product listing will show an estimated dispatch date or window. This is an estimate made in good faith, not a guaranteed date.

b. Payment is taken at the time of your order.

c. We will dispatch your pre-order by the estimated date shown, or by any revised date we agree with you. If we cannot, we will tell you as soon as we know, and you may either wait for the revised date or cancel for a full refund.

d. You may cancel a pre-order at any time before dispatch, for any reason, and receive a full refund. This is in addition to your 14-day cancellation right after delivery.

e. If we are unable to supply the product at all, we will cancel your order and refund you in full. This is the limit of our responsibility to you where a pre-order cannot be fulfilled.

7. Price and payment

Prices are shown in pounds sterling and include VAT where applicable. Delivery charges are shown separately at checkout before you pay. The total shown at checkout is the total you pay. There are no additional charges added later.

If we discover an error in the price of a product you have ordered, we will contact you before dispatch. You may confirm the order at the corrected price or cancel it. If we cannot reach you, we will treat the order as cancelled and refund you in full.

8. Delivery

Delivery timescales, costs and areas we ship to are set out in our Shipping Policy, which forms part of these terms.

Your order becomes your responsibility once it is delivered to the address you gave us.

9. Returns and refunds

Your cancellation and refund rights are set out in our Refund and Returns Policy, which forms part of these terms.

10. Our website

We may change or withdraw our website, or any product on it, at any time. We do not guarantee the website will always be available or uninterrupted.

We take care to describe our products accurately, and images are as accurate as our display process allows. Minor variations in colour, texture or scent may occur between batches and are not defects.

You must not misuse our website, attempt to gain unauthorised access to it, or introduce anything malicious to it.

11. Intellectual property

All content on zemaskin.com, including the Zema name and logo, text, photographs, graphics and design, belongs to us or is used under licence. You may not copy, reproduce or use it commercially without our written permission.

12. Reviews and content you submit

If you submit a review, photograph or other content to us, you confirm it is your own honest experience, and you grant us a non-exclusive, royalty-free licence to use it in our marketing.

We do not pay for reviews, and we do not remove genuine negative reviews. We may remove content that is unlawful, offensive, or makes medical claims we are not permitted to publish.

13. Our responsibility to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the products.

We only supply products for domestic and private use. We are not liable for loss of profit, loss of business, or business interruption.

14. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control. If such an event occurs we will contact you as soon as possible, and you may cancel your order and receive a full refund for anything not delivered.

15. Complaints

If something has gone wrong, email support@zemaskin.com and we will do our best to resolve it. If we cannot resolve it between us, you may be able to use an alternative dispute resolution provider or take the matter to court.

16. General

We may transfer our rights and obligations under these terms to another organisation, and will tell you if we do. You may only transfer your rights to someone else if we agree in writing.

If any part of these terms is found to be unlawful, the remaining parts continue to apply.

If we do not insist that you do something you are required to do under these terms, or delay in taking action, that does not mean we have given up our right to do so later.

These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.
